By means of this Privacy Policy, Deltalight (hereinafter “we”, “us”, “our”) wishes to provide you, the visitor of our websites https://www.deltalight.com, https://www.deltalightgroup.com, https://jobs.deltalightgroup.com, https://www.aqform.com, http://www.ledsgo.eu, https://www.vltcorp.com, https://lfillumination.com, https://delraylighting.com and https://www.softformlighting.com (hereinafter jointly referred to as the “Website”) with information about relevant data protection-related aspects of our personal data processing activities. This Privacy Policy may be amended or updated to reflect relevant changes. To know when this Privacy Policy was last updated, please refer to the “Last Update” date indicated at the bottom of this page. Any change made to this Privacy Policy will take effect upon publication on our Website.

The controller responsible for the processing of your personal data on our Website is DELTA LIGHT N.V., a limited liability company under Belgian law, with registered office at Muizelstraat 2, 8560 Wevelgem (Belgium), and registered with the Belgian Crossroads Bank for Enterprises under company number 0432.671.468.

Jointly with the abovementioned controller, the purposes and means of the processing of personal data in the context of our brand websites are determined by the following legal entities:

2. Personal data processing activities

Please note that we are only involved in B2B-relations and that, thus, we are not directly interacting with consumers. In this section, we describe how we may process your personal data when you interact with us, or when your personal data are provided to us for one of the purposes described below.

2.1 website

Based on our legitimate interest to provide a well-functioning and secure website, we process information associated with the device you use to visit our Website, such as type of device, IP address, MAC address, screen resolution, operating system, internet browser, system language, or location.

If you provide your consent via our cookie banner or our Privacy Preference Center that is available via the “Cookies Settings” button at the bottom of our Website, we process information about your online behavior (pages visited, information downloaded, consultation of our newsletters, etc.) via cookies and other tracking technologies, as described in our Cookie Policy.

Additionally, based on our legitimate interest to ensure the safety of our digital ecosystem, to protect our rights, or to enforce our policies or terms of use, we may process personal data for such purposes too.

It is not our intention to collect or otherwise process personal data of children.

2.2 My Deltalight

When you sign up as a Deltalight registered user on My Deltalight, your personal data will be processed as necessary to perform the contract and to provide you with access to an online platform where you can quickly and easily collect, save, download, and share images and product information at any stage of your project, all in one central location. Without such personal data, we would not be able to provide these functionalities.

2.3 CTRL DELTA

When you download the CTRL DELTA app on your mobile device to wirelessly control CTRL DELTA enabled luminaires, your personal data will be processed as necessary to perform the contract and provide you with the CTRL DELTA functionalities. Without such personal data, we would not be able to provide the requested functionalities.

2.4 PROFILE BUILDER 

When you sign up for the online configurator Profile Builder that enables you to create seamless and continuous light lines, your personal data will be processed as necessary to perform the contract and provide you with the Profile Builder functionalities. Without such personal data, we would not be able to provide the requested functionalities.

2.5 Customer Portal

When you provide your consent to process your personal data as contact person for a Deltalight partner on our Customer Portal, we will process your information to contact the a Deltalight partner and to provide information on real-time stock insights, order management, delivery information, prices, project registration, webinars, marketing tools and much more. Before providing personal data about additional users, please make sure that they have read this Privacy Policy, and that you have a legal basis to provide the personal data in question.

2.6 Vendor portal 

When you are a contact person for one of our vendors, your personal data will be processed on our Vendor Portal based on our legitimate interest to interact with them via an online platform.

2.7 Product information 

When you provide your consent to process your personal data on behalf of yourself or as contact person for a customer or prospect by requesting information about our products, (e.g., via the Contact form on our website, by requesting our printed catalogue, or in our showroom or at an event or meeting), we will process your information to provide the requested information.

2.8 Event organization 

When you provide your consent by subscribing to an event, and based on our legitimate interest to ensure its proper and safe organization and follow-up, we may process your personal data to register you for the event, keep you informed about practicalities, provide a Wi-Fi at the event location, provide other relevant information before during and after the event, etc. Pictures will only be taken if you are duly informed, and if we have an appropriate legal basis.

2.9 Relationship management

Based on our legitimate interest to build, maintain and manage business relationships, your personal data may be processed when you have been in contact with us in our showroom, at an event or meeting, during a visit of one of our representatives, etc., or when you have otherwise expressed interest in us and/or our products or services.  

Based on your consent or our legitimate interest to follow up on business leads, we may also process personal information provided to us by third parties, such as via specialized professional platforms where we are actively present, e.g., Architonic, ArchDaily, Dezeen, etc., or the attendance list of conventions and events where we actively participate.

In case our communications are considered as “direct marketing” under applicable legislation, we will ensure that we have a proper legal basis, such as consent, for such processing.

2.10 Social Media 

If you visit or register to our social media pages on Facebook, Instagram, LinkedIn, X,
Pinterest, Vimeo or other social media platforms, we may collect personal data to allow interaction on such platforms or communicate with you via other means.

Please be informed that social media platforms also collect personal data for their own purposes. Please read their respective privacy policies to be duly informed about their personal data processing activities and your related rights.

2.11 Job site 

When you provide your personal data to apply for a job on our jobsite, your personal data will be processed to assess your candidacy. Your personal data will only be accessible to individuals directly involved in the recruitment and selection process.

If you are hired, our HR Privacy Policy will become applicable.

2.12 Newsletter 

When you provide your consent by subscribing to our newsletter, and once you have confirmed your subscription via the activation email, or when you have indicated your interest in our products and services, and unless you have unsubscribed after we contacted you for the first time following our first contact, we will process the personal data provided in the registration form to provide you with inspiring projects, our latest innovations and event invitations.

2.13 Other interactions

If you contact us by email, phone, message, or any other means for other purposes than the ones described above, we will process your personal data to follow up on such communication.

If your personal data have been provided to us as a contact person for our customers or business prospects, based on our legitimate interest to interact with them to conduct our business, your personal data will be processed to interact with them for business development, handing and processing requests for quotations and orders, issuing invoices, delivery and/or installation of products, providing technical or other after-sales support, executing contractual or statutory warranties and indemnities, handling possible complaints, product training, etc.

2.14 Whistleblowing

We have implemented a “Whistleblower Policy” in accordance with the legal requirements of Directive 2019/1937 on the protection of persons who report breaches of Union law, and the Belgian law of November 28, 2022 implementing such directive. If your personal data are processed to handle, evaluate and, if necessary, further investigate (anonymous) reports, we will carry out such processing based on our legal obligation to comply with the aforementioned legislation.

2.15 Compliance

In addition to the processing of your personal data for the purposes set out above, we may process your personal data for our legitimate interest to audit or otherwise verify that our internal processes function as intended and are compliant with applicable laws, regulatory requirements, or contractual obligations, so that we can keep our assets and business safe from misuse and illegal activity, and to enforce our policies.

We may also process your personal data to comply with applicable legal obligations or based on our legitimate interest to comply with regulatory requests.

Furthermore, we may process your personal data in the context of corporate operations, including any form of reorganization, based on our legitimate interest to conduct our business in good faith.

3. With whom do we share your personal data?

Your personal data may be exchanged between the controllers mentioned in section “Controllers” above for the purposes described in this Privacy Policy.

Your personal data may be processed on our behalf by processors providing business support services, such as direct mailing, website hosting, physical security, marketing, market research, etc.

We may also disclose your personal data to third parties who assist us in the context of disputes and litigation, such as the liability insurer or attorneys and bailiffs in the context of legal proceedings, or to protect our property, safety, people and other rights and interests.

Additionally, we may also disclose your personal data to third parties in the context of a business reorganization, e.g., to prospective purchasers of shares or companies with which we may merge with, or which may wish to acquire all or part of our business or assets.

We may also be required to disclose your personal data to law enforcement bodies, regulators, agencies or third parties under a legal requirement or court order. Lastly, please be informed that we do not sell your personal information.

4. International data transfers

We are an international organization, with businesses both inside and outside of the European Economic Area ("EEA"). Parties who process personal data on our behalf may be based in locations around the world, and we may be subject to scrutiny from courts or regulators in different jurisdictions. For these reasons, your personal data may be transferred to other countries both inside and outside the EEA.

As privacy laws in other countries may not be equivalent to those in your home country, we only make arrangements to transfer data overseas where we are satisfied that adequate levels of protection are in place.

5. For how long do we store your personal data?

We store your personal data for as long as necessary for the purposes for which the personal data are processed, as described in Section ‎2 above.

If you are a job applicant, your personal data will be kept for a maximum of 1 year after first registration on our jobsite. After 1 year, you will be contacted to check whether you wish to remain in our database. If you do not actively confirm this within 30 days, your personal data will be irrevocably removed from our job database.

6. Your data 

Under the conditions foreseen in the applicable data protection legislation, you have the right to request access to and rectification or erasure of your personal data, to restriction of processing, and to data portability.

Under the conditions foreseen in the applicable data protection legislation, where the processing is based on consent, you have right to withdraw consent at any time.

Under the conditions foreseen in the applicable data protection legislation, you have the right to object, on grounds relating to your particular situation, at any time to processing of your personal data which is based on our legitimate interests, including profiling based on those provisions. Where personal data are processed for direct marketing purposes, you have the right to object at any time to processing of your personal data for such marketing, which includes profiling to the extent that it is related to such direct marketing.

You also have the right to lodge a complaint with a supervisory authority.
